Terms of Service

Effective April 1, 2026

Service Overview

EdSystems provides AI-powered admissions agents to private K-12 schools. Our agents handle inbound and outbound voice calls, SMS conversations, and web chat on behalf of partner schools. These terms govern your use of and interaction with EdSystems services.

AI Disclosure

EdSystems admissions agents are artificial intelligence, not human staff. They are designed to answer admissions questions, schedule campus tours, and coordinate callbacks on behalf of the school. A human admissions staff member is available via live transfer during school business hours. The AI agent will transfer you upon request or when appropriate.

For Families

When you interact with an EdSystems-powered admissions agent by phone, SMS, or web chat, you agree to the following:

Recording Consent

By continuing a voice call after the recording disclosure at the beginning of the call, you consent to the recording and transcription of that call. If you do not wish to be recorded, you may disconnect at any time.

SMS Consent and Opt-Out (TCPA)

By providing your phone number and engaging in SMS communication with an EdSystems agent, you consent to receive text messages related to your admissions inquiry, consistent with the Telephone Consumer Protection Act (TCPA). You may opt out at any time by replying STOP. After opting out, you will receive no further SMS messages from that school's EdSystems agent. Standard message and data rates apply. Your mobile information will not be sold or shared with third parties for promotional or marketing purposes.

Children's Privacy (COPPA)

EdSystems agents communicate exclusively with parents and legal guardians. We do not knowingly collect personal information directly from children under 13, consistent with the Children's Online Privacy Protection Act (COPPA). If you believe a child has provided information directly to an EdSystems agent without parental consent, contact us at jduncan@edsystems.io and we will promptly remove it.

For Schools (FERPA)

Partner schools engage EdSystems under a separate service agreement. EdSystems processes family and student data on behalf of the school as a data processor under the Family Educational Rights and Privacy Act (FERPA). The school is the FERPA-covered educational institution and remains the data controller, responsible for its own admissions policies, enrollment decisions, and FERPA compliance. EdSystems accesses student information solely at the school's direction to perform admissions services.

Acceptable Use

You agree not to:

Intellectual Property

EdSystems owns all rights to its AI agent technology, conversation architectures, workflows, and aggregated de-identified data derived from interactions across all partner schools. Individual family data belongs to the family and the partner school. De-identified, aggregated data used to improve AI models does not contain personally identifiable information and is the property of EdSystems.

Accuracy and Disclaimers

EdSystems agents provide information based on data supplied by partner schools. While we work to ensure accuracy, we do not guarantee that all information provided by the agent is current or complete. Tuition rates, program availability, seat availability, and school policies are subject to change by the school at any time. Families should confirm critical details directly with the school's admissions office.

Limitation of Liability

EdSystems provides its services on an "as is" basis. To the fullest extent permitted by law, EdSystems shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or interaction with our services, including but not limited to missed communications, scheduling errors, or inaccurate information provided by the AI agent.

Governing Law

These terms are governed by the laws of the State of Wyoming. Any disputes arising from these terms shall be resolved in the courts of the State of Wyoming.

Changes to These Terms

We may update these terms from time to time. The effective date at the top of this page reflects the most recent revision. Continued use of our services after changes constitutes acceptance of the updated terms.
